This responsibility encompasses adherence to all user manuals, safety instructions, and maintenance recommendations that accompany the equipment.
3. Assumption of Risks: You concede that the utilization of commercial appliances in a residential setting may entail particular risks, including, but not limited to, heightened wear and tear, potential equipment damage, and concerns regarding personal safety. You voluntarily assume all such risks.
4. No Liability: Kitchen Pro Equipment will not be held accountable for any resulting damages, losses, injuries, or expenditures stemming from the use of our commercial appliances in a residential setting. This encompasses repair or replacement costs, personal harm, or property damage.
5. Warranty Eligibility: Should you intend to employ our equipment within a commercial or professional context, we urge you to get in touch with our customer service department to explore warranty options tailored to your requirements.
6. Compliance: You agree to adhere to all pertinent local, state, and federal laws, regulations, and permits relating to the utilization of commercial appliances in a residential environment. Noncompliance may lead to legal repercussions.

Kitchen Pro Equipment
Orders Availability
In-stock items generally ship in 1–2 business days. For items shipping from the manufacturer, estimated processing times are listed on the item’s page. If we do not have enough stock on hand to fulfill your order, we will send you an email notification within 24 business hours. If you have a time constraint on your order, please respond to that email so that our team can work on a solution for you.
Tracking Information
Once your order has shipped, tracking information will be available and sent to you within 24–48 business hours. Please note that this timeframe is determined by the freight carriers’ systems and may vary slightly depending on the carrier.
Delivery and Risk of Loss
All deliveries are made curbside unless otherwise specified and paid for in advance. The risk of loss or damage to the product transfers to the customer once the product is delivered to the shipping carrier. Kitchen Pro Equipment is not responsible for loss, damage, or theft after the carrier takes possession. Customers are responsible for inspecting shipments upon delivery and noting any damages or shortages on the delivery receipt at the time of delivery. Claims for damage or missing items must be made directly with the carrier.
Freight and Accessorial Charges
Freight charges cover standard curbside delivery only. Additional services such as liftgate, inside delivery, limited access delivery, or white glove service must be arranged in advance and may incur extra charges. Customers are responsible for any accessorial fees billed by the carrier due to incorrect, incomplete, or inaccurate shipping information provided at the time of order.
Cancellation by Kitchen Pro Equipment
We reserve the right to cancel any order, refund, credit, or reshipment at our discretion without notice. Kitchen Pro Equipment also reserves the right to refuse service, terminate accounts, and terminate your rights to use Kitchen Pro Equipment’s website, mobile website, or mobile application services (“Services”). If we do so, we will not provide any type of reimbursement for termination related to conduct that we determine, in our discretion, violates our policies or any applicable law, involves fraud or misuse of the Kitchen Pro Equipment Services, or is harmful to our interests or another user.
Cancelling an Order
Once an order is placed, we cannot guarantee that it can be cancelled. If you wish to cancel an order, please contact us as soon as possible. A cancellation and/or restocking fee may be deducted from your return credit to cover the cost of cancelling the items and/or processing the items back into stock. This fee could be up to 50% of the item(s)’ cost. Customized products are non-modifiable, non-cancellable, and non-returnable.
Returns and Restocking
Returns must be requested within 30 calendar days of delivery and are subject to Kitchen Pro Equipment’s approval. Returned items must be in new, unused condition, in the original packaging, and accompanied by a return authorization number. Unauthorized returns will not be accepted. Restocking fees may apply and can be up to 50% of the purchase price. Shipping and handling charges are non-refundable, and customers are responsible for return shipping costs.
Modifying an Order
Once your order is placed, we cannot guarantee that it can be modified. If you wish to modify your order, please contact us as soon as possible.
Payments and Chargebacks
By placing an order, you agree to provide accurate billing and payment information. Any chargebacks initiated with your bank or credit card company without first contacting Kitchen Pro Equipment to resolve the issue will be considered a breach of this Agreement. We reserve the right to pursue collection actions, including legal remedies, and to recover associated fees, interest, and costs.
Product Warranty
Some products offered by Kitchen Pro Restaurant Equipment may come with a manufacturer’s warranty. When available, warranty details can typically be found within the product description or as a downloadable document directly on the product page. All manufacturer warranties are governed strictly by the terms and procedures established by the individual manufacturer. Because warranty coverage and conditions differ between manufacturers, we strongly recommend contacting our Customer Support Team to confirm warranty specifics prior to placing your order.
Unless a warranty has been purchased directly from Kitchen Pro Restaurant Equipment or a manufacturer’s warranty is explicitly indicated on the product page, Kitchen Pro Restaurant Equipment makes no additional warranties of any kind—express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or warranties arising from course of performance, dealing, or trade usage.
If you incorporate a product purchased from us into a separate item or system that you manufacture or assemble, you assume full responsibility and liability for the final product. Kitchen Pro Restaurant Equipment will not be held liable for any aspect of a product’s performance or safety once it has been integrated into another product.
This disclaimer does not override or limit any rights or warranties that cannot be legally excluded under applicable law.
Limitation of Liability

This includes, without limitation, any errors, delays, malfunctions, inaccuracies, or omissions.
This limitation covers all types of damages, whether direct or indirect, incidental or consequential, including but not limited to:

- Food spoilage or product loss
- Lost revenue, profits, or business opportunities

- Business interruption or anticipated savings
- Reputational harm or loss of goodwill
These limitations apply regardless of the legal theory asserted—whether based on negligence, contract breach, strict liability, or any other theory—even if Kitchen Pro Restaurant Equipment was advised of the possibility of such damages.

Force Majeure
Kitchen Pro Equipment shall not be liable or responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, government actions, labor disputes, supply chain interruptions, transportation delays, pandemics, or acts of terrorism.
Indemnification
You agree to indemnify, defend, and hold harmless Kitchen Pro Equipment and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of your misuse of the product, violation of these Terms of Sale, or violation of any applicable law.
Governing Law and Jurisdiction
These Terms of Sale shall be governed by and construed under the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Collier County, Florida. By placing an order, you consent to the personal jurisdiction of these courts.
Curb Side Delivery:

All equipment purchased through our Kitchen Pro Equipment website will be delivered via curb side delivery. It is the customer's responsibility to ensure the equipment is safely transported and brought inside their premises.
